The rules for using Tradeltop as a customer, trade company, or visitor to the platform.
Terms of Use
1. About These Terms
These Terms of Use govern access to and use of Tradeltop's websites, apps, products, and services.
In these Terms:
By creating an account, posting a Job, creating a Trade Company profile, purchasing Credits, unlocking a Lead, or otherwise using the Platform, you agree to these Terms.
If you do not agree, you must not use the Platform.
Important Trade Company Terms
If you are a Trade Company, you should pay particular attention to the sections about Tradeltop's role, verification, Credits, Lead unlocks, Lead reviews, refunds, account suspension, Platform changes, liability, and indemnity.
Before a Trade Company buys Credits or unlocks a Lead, Tradeltop will take reasonable steps to make the key paid-feature terms clear, including:
- "Tradeltop", "we", "us", or "our" means Tradeltop Pty Ltd ABN 96 698 562 935, ACN 698 562 935.
- "Platform" means the Tradeltop website, mobile app, web app, APIs, messaging tools, job tools, company profile tools, payment flows, and related services.
- "Customer" means a person or organisation looking for trade or property services.
- "Trade Company" means a trade business, contractor, company, sole trader, or representative using the Platform to create a profile, receive job opportunities, quote, message Customers, or manage leads.
- "User" means a Customer, Trade Company, or any other person who accesses the Platform.
- "Job" means a job request, lead, brief, quote request, task, project, or work opportunity submitted through the Platform.
- "Lead" means a Job opportunity made available to a Trade Company.
- "Credits" means prepaid Tradeltop credits that may be used to unlock Lead details or other paid Platform features.
- the Credit pack price or Credit cost shown at checkout or before unlock;
- the fact that Credits are used for eligible paid Platform features and are not cash;
- whether a Lead unlock is exclusive or non-exclusive;
- what Customer contact or Job information will be made available;
- that a Lead unlock does not guarantee Customer response, quote acceptance, work, revenue, or profit;
- any applicable Lead review, Credit return, or refund rules; and
- the fact that Tradeltop does not offer subscriptions, minimum contract terms, auto-renewals, or early termination fees at launch.
2. Tradeltop's Role
Tradeltop provides a marketplace and workflow platform that helps Customers describe Jobs, prepare job briefs, find matched Trade Companies, request quotes, communicate, and track progress.
Tradeltop also helps Trade Companies create profiles, set services and service areas, manage availability, review matched Leads, unlock contact details where available, message Customers, and manage opportunities.
Unless expressly stated otherwise:
Customers and Trade Companies are responsible for deciding whether to enter into a separate work agreement with each other.
- Tradeltop is not a builder, plumber, electrician, contractor, project manager, certifier, inspector, insurer, or trade service provider.
- Tradeltop is not a party to the work agreement between a Customer and a Trade Company.
- Tradeltop does not employ, supervise, direct, control, or guarantee Trade Companies.
- Tradeltop does not guarantee that a Customer will choose a Trade Company, respond to a Trade Company, proceed with a Job, accept a quote, or pay for trade work.
- Tradeltop does not guarantee that any Trade Company is available, suitable, licensed, insured, qualified, or legally permitted to perform a Job unless we expressly state that we have verified a specific credential.
3. Eligibility And Accounts
You must be at least 18 years old to create an account or use the Platform for commercial purposes.
You must provide accurate, current, and complete information when creating an account, posting a Job, creating a company profile, buying Credits, or communicating through the Platform.
You are responsible for:
We may refuse, suspend, or close an account if we reasonably believe that the account information is inaccurate, misleading, fraudulent, unsafe, unlawful, or inconsistent with these Terms.
- keeping your login details secure;
- all activity under your account;
- promptly updating inaccurate or outdated information;
- ensuring your use of the Platform complies with applicable laws; and
- notifying us if you suspect unauthorised access to your account.
4. Customer Terms
Customers may use the Platform to describe Jobs, add photos, provide location and timing details, answer follow-up questions, receive suggested trade categories, review matched Trade Companies, send Jobs, receive quotes or messages, and track Job progress.
Customers must:
Customers acknowledge that:
- provide accurate Job details;
- only upload photos, documents, and information they have the right to provide;
- avoid posting unlawful, unsafe, discriminatory, offensive, misleading, or irrelevant Jobs;
- check whether a Trade Company is suitable before engaging them;
- check ABNs, registered business names, licences, insurance, qualifications, references, reviews, quote terms, contract terms, warranties, deposits, progress payments, permits, approvals, and certificates where relevant;
- ensure the property owner or authorised representative consents to the Job being posted if the Customer is not the owner;
- comply with any site access, safety, strata, body corporate, tenancy, landlord, or property management requirements; and
- pay Trade Companies as agreed directly with them.
- Tradeltop may use Job details, answers, photos, timing, location, and other submitted information to prepare a Job brief and match Trade Companies.
- Tradeltop may use the Customer's address to determine accurate geolocation and find nearby Trade Companies.
- Tradeltop may share relevant Job information with matched or selected Trade Companies, but Tradeltop does not share the Customer's full street address with Trade Companies unless the Customer chooses to share it.
- Tradeltop does not take payment for trade work. How and when a Customer pays a Trade Company is decided directly between the Customer and the Trade Company.
- A Trade Company may need additional site inspection, measurements, photos, certifications, or information before giving a final quote.
- Any price estimate, trade suggestion, AI summary, or matching result is general assistance only and is not professional, building, engineering, legal, financial, or safety advice.
5. Trade Company Terms
Trade Companies may use the Platform to create a public business profile, list services, set service areas, manage availability, receive matched Leads, review Lead previews, unlock Lead details using Credits, message Customers, and send quotes.
Trade Companies must:
Where a Trade Company acts through an employee, subcontractor, representative, or account user, the Trade Company is responsible for that person's use of the Platform.
- provide accurate business, contact, ABN, licence, insurance, service, location, and availability information;
- only offer services they are legally permitted, licensed, qualified, insured, and competent to perform;
- keep profiles, prices, service areas, credentials, and availability up to date;
- comply with workplace health and safety, building, electrical, plumbing, gas, consumer, privacy, spam, and fair trading laws that apply to their services;
- honour quotes, warranties, appointment times, cancellation terms, and service commitments they provide to Customers;
- not misrepresent affiliation, verification, licences, insurance, qualifications, experience, availability, or pricing;
- not pressure, harass, spam, mislead, or discriminate against Customers;
- not use Customer contact details for unrelated marketing, resale, data harvesting, or any purpose outside the relevant Job; and
- promptly tell Tradeltop if account access, licence status, insurance status, or business authority changes.
6. Verification And Credentials
Tradeltop verifies email address access for account and communication purposes where supported by the Platform.
Tradeltop may allow Trade Companies to submit business details, ABNs, licences, insurance documents, images, descriptions, and other credentials.
At launch, other than email address verification, Tradeltop allows Trade Companies to submit ABN, licence, insurance, and credential information, but Tradeltop does not verify that an ABN belongs to the Trade Company, does not verify insurance, and does not verify trade licences or other credentials.
Unless Tradeltop expressly states in the Platform that a specific credential has been verified, Tradeltop does not represent that the information has been independently checked.
Trade Companies must not state or imply that Tradeltop has verified, approved, endorsed, certified, licensed, insured, or recommended them unless Tradeltop has expressly provided that status in the Platform.
If Tradeltop does verify a credential:
- verification is limited to the credential and date shown;
- verification does not guarantee ongoing validity, quality, workmanship, legal compliance, safety, availability, or suitability;
- the Trade Company remains responsible for keeping the credential current; and
- Tradeltop may remove a badge, verification status, profile, or listing if we reasonably believe it is inaccurate, outdated, misleading, or unsafe.
7. Jobs, Quotes, And Trade Work
Any quote, estimate, site inspection, contract, work order, variation, invoice, warranty, deposit, refund, cancellation, workmanship issue, damage claim, delay, payment timing, payment method, or dispute about trade work is between the Customer and the Trade Company.
Trade Companies are responsible for:
Customers are responsible for deciding whether to accept a quote or engage a Trade Company.
For Queensland domestic building work, Customers and Trade Companies should be aware that:
Official guidance about Queensland building contracts, deposits, progress payments, licensing, electrical work, and plumbing work is available from the QBCC and Queensland Government. Users should check current guidance before agreeing to work or payment terms.
Similar licensing, contract, deposit, insurance, certificate, approval, and consumer protection rules may apply in other states and territories. Customers and Trade Companies should check the rules that apply to the Job location and trade type before entering into a work agreement or making payment.
Tradeltop may provide support tools or help users communicate, but Tradeltop is not required to mediate, arbitrate, inspect, supervise, or resolve disputes about trade work.
- assessing the Job before accepting or quoting;
- obtaining required licences, permits, approvals, inspections, and certifications;
- complying with Australian Consumer Law, state and territory trade licensing laws, building laws, safety laws, and applicable industry requirements;
- providing legally required consumer guarantees, warranties, certificates, invoices, and receipts; and
- resolving issues with Customers about work quality, completion, delays, damage, payment collection, payment timing, payment methods, and refunds.
- domestic building work priced over $3,300 including labour, materials, and GST generally requires a written, dated, and signed contract agreed before work begins;
- domestic building work priced at $20,000 or more generally requires additional contract documents, including a QBCC-approved consumer building guide before signing;
- Queensland law limits deposits for many domestic building contracts, commonly to 20% where the work is valued at $3,300 or less, 10% where the contract price is $3,301 to $19,999, 5% where the contract price is $20,000 or more, or 20% where the value of work to be performed off-site is more than 50% of the contract price;
- progress payments for domestic building work over $3,300 should relate to the amount of work completed;
- Customers should not pay the full contract price in advance; and
- some building, electrical, plumbing, gas, pool safety, and other regulated trade work can only be performed, advertised, supervised, or contracted by appropriately licensed people or businesses.
8. Coverage And Matching
Tradeltop is available to Customers and Trade Companies across Australia, subject to Platform availability, supported features, and applicable laws.
Tradeltop does not guarantee that:
Coverage depends on Customer demand, Trade Company participation, service areas, availability settings, trade categories, timing, location, and matching results.
- a Customer will find available Trade Companies in their area;
- a Customer will receive responses, quotes, or offers from Trade Companies;
- any particular trade category, suburb, region, state, or territory will have active Trade Companies;
- a Trade Company will receive Leads in its service area; or
- Customer demand will exist in any particular service area or trade category.
9. Credits And Lead Unlocks
This section applies to Trade Companies that purchase or use Credits.
Credits may be purchased through the Platform using the payment methods made available at checkout. Payments may be processed by third-party payment providers such as Stripe.
The current advertised Credit packs are Just starting out (4 Credits for $40, or $10 per Credit), Boss mode (12 Credits for $96, or $8 per Credit), and The Workhorse (24 Credits for $144, or $6 per Credit). The Credit quantity, price, availability, and tax treatment shown at checkout apply to a purchase. Tradeltop may change future pack offerings or prices in accordance with applicable law.
Launch offer: a Trade Company that creates an account on or before 1 November 2026 receives 15 free Credits. For the 6 months starting on that account's creation date, each eligible Lead unlock costs 1 Credit. After that period, the Credit cost shown before unlock applies.
Unless stated otherwise at checkout:
Credits do not expire.
The number of Credits required to unlock a Lead may vary and may change over time. One Credit does not necessarily equal one Lead. Tradeltop will show the Credit cost before a Trade Company unlocks a Lead.
After unlocking a Lead, the Trade Company may receive access to the Customer's phone number, email address, and in-app messaging for that Job. Tradeltop does not share the Customer's full street address through a Lead unlock unless the Customer chooses to share it.
Unlocking a Lead does not guarantee:
Job Lead Contact Purchases
A Trade Company may use Credits to purchase access to a Customer's contact details for a specific Job Lead.
Purchasing a Job Lead gives the Trade Company access to the Customer's contact details for that Job only. It does not give the Trade Company ownership of the Lead or an exclusive right to contact the Customer.
Purchasing a Job Lead does not guarantee that the Customer will respond, request a quote, accept a quote, select the Trade Company, or proceed with the work.
Up to three Trade Companies may have active purchase windows for the same Job Lead at one time.
Each contact purchase has a 72-hour active response window starting when the Trade Company successfully purchases access to the Customer contact details.
During the 72-hour active response window, the purchase counts toward the limit of three active Trade Companies for that Job Lead.
Once a Trade Company's 72-hour active response window expires, that purchase no longer counts toward the active limit, and another Trade Company may be allowed to purchase the same Job Lead.
A Trade Company that has already purchased a Job Lead keeps access to the Customer contact details after the 72-hour active response window expires.
A Trade Company will not be charged again to view Customer contact details for the same Job Lead it has already purchased.
If three Trade Companies already have active purchase windows for a Job Lead, another Trade Company may be prevented from purchasing that Lead until one of those active windows expires. If a purchase is blocked because the active limit has been reached, no Credits are charged.
Credits are only charged when the contact purchase is successfully completed and the Customer contact details are made available. If a Trade Company does not have enough Credits, the contact purchase will not proceed and the Customer contact details will not be revealed.
Rejecting, ignoring, or not responding to a Job Lead does not immediately release the active purchase slot. The purchase remains active until the 72-hour response window expires.
The active purchase limit is intended to reduce Customer overload. It does not give any Trade Company exclusive access to a Job Lead.
In rare cases, simultaneous purchases may result in more than three active Trade Companies for the same Job Lead.
Trade Companies must only use Customer contact details for the purpose of responding to the purchased Job Lead. Trade Companies must not share, resell, misuse, or use Customer contact details for unrelated marketing or any purpose unrelated to the purchased Job Lead.
Subscriptions And Auto-Renewals
Tradeltop does not offer subscriptions, minimum contract terms, auto-renewals, or early termination fees at launch. Trade Companies buy Credit packs and use Credits to unlock Leads or other paid features.
If Tradeltop later introduces a subscription, membership, recurring payment, auto-renewing product, minimum contract term, or early termination fee, it will not apply to a Trade Company unless the Trade Company separately accepts the relevant product terms, price, renewal rules, cancellation method, and any applicable minimum term or termination fee.
- prices are in Australian dollars, and GST will be shown where it applies;
- Credits are account credits that may be used to unlock eligible Leads or other eligible paid Platform features;
- Credits are not cash and are not redeemable outside the Platform;
- Credits are not transferable, assignable, redeemable for cash, or usable outside Tradeltop;
- Credits may not be resold, pooled, or transferred between accounts without Tradeltop's written approval; and
- Credits are consumed when a Trade Company unlocks a Lead or uses another paid feature that clearly states Credits will be consumed.
- that the Customer will respond;
- that the Customer has not contacted or selected another Trade Company;
- that the Customer will proceed with the Job;
- that the Customer will accept a quote;
- that the Job will be profitable;
- that the Job details are complete or accurate;
- that the Customer can legally proceed with the Job; or
- that the Trade Company will recover the value of the Credits used.
10. Lead Review And Credit Return Policy
A Trade Company may request a Lead review within 7 days after unlocking a Lead if one of the following applies:
The 7-day Lead review window applies to Tradeltop's discretionary Lead review process and does not limit any non-excludable rights under the Australian Consumer Law or other applicable law.
For this policy, a Lead may be treated as spam, fraudulent, abusive, or not genuine if the available information indicates that the Job was created for scam, harassment, testing, spam, data harvesting, abusive, unlawful, or non-genuine purposes, or if the Customer contact details are materially false.
A Credit return would not usually be available merely because:
Tradeltop may review Platform records, Job content, contact details, account activity, messages, duplicate Job signals, cancellation status, matching records, and any evidence provided by the Trade Company before deciding whether to return Credits.
Credit returns are generally provided as replacement Credits, not cash refunds, unless required by law or unless Tradeltop materially breached these Terms.
- the Lead is clearly spam, fraudulent, abusive, or not a genuine Job request;
- the Customer contact details provided by Tradeltop are materially invalid;
- the Lead was matched outside the Trade Company's selected service area because of a Tradeltop matching error;
- the Lead was matched to a trade category the Trade Company does not offer because of a Tradeltop matching error;
- the Customer had already cancelled the Job before the Trade Company unlocked it and Tradeltop failed to show that status; or
- the same Customer Job was charged twice to the same Trade Company due to a technical error.
- the Customer does not respond;
- the Customer chooses another Trade Company;
- the Customer changes their mind after unlock;
- the Customer's budget is lower than the Trade Company's quote;
- the Trade Company decides the Job is too small, too far away, too difficult, or not profitable after unlock, where the preview was materially accurate;
- the Trade Company did not read the Lead preview carefully;
- the Trade Company was unavailable despite its availability settings; or
- the Trade Company breached these Terms.
11. Payments, Taxes, And Refunds
Trade Companies must pay all fees shown at checkout or otherwise agreed before paid lead features are supplied.
Tradeltop uses payment records in Tradeltop and third-party payment processors such as Stripe to process Trade Company Credit purchases. By using a payment feature, you may also be subject to the payment processor's terms.
Tradeltop only takes payment from Trade Companies for Credits, Lead unlocks, and other paid Platform features expressly offered to Trade Companies.
Tradeltop does not take payment for any trade work performed by a Trade Company. Tradeltop does not collect, hold, release, escrow, process, refund, charge back, guarantee, or mediate payments for trade work. Deposits, invoices, progress payments, final payments, refunds, chargebacks, payment timing, payment method, and payment disputes for trade work are handled directly between the Customer and the Trade Company.
Prices shown for Credit purchases and other Tradeltop-charged purchases are in Australian dollars, and GST will be shown where it applies.
Tradeltop may issue invoices, receipts, or tax invoices where required or where supported by the Platform.
Nothing in these Terms limits any non-excludable rights under the Australian Consumer Law or other applicable law.
Refunds for Credit purchases are only available:
If Tradeltop permanently discontinues Credits or removes the main paid Platform features for which unused Credits can be used, Tradeltop will take reasonable steps to provide affected Trade Companies with a fair resolution. Depending on the circumstances, this may include a reasonable period to use unused Credits, replacement Platform value, transfer of Credits, account credit, or a refund where required by law.
Before a Trade Company voluntarily confirms permanent account deletion, the account closure tool shows its current unused Credits. The Trade Company can cancel deletion and use those Credits before closing its account. By deliberately confirming deletion, the Trade Company elects to forfeit its remaining unused Credits, including Credits already purchased, subject to its non-excludable legal rights. This voluntary election does not remove any refund or other remedy required by law.
If a Trade Company account is suspended, unused Credits remain associated with the account while Tradeltop reviews the account, unless the Credits are reversed, removed, or adjusted because of fraud, chargeback, payment failure, misuse, or another breach of these Terms.
If a Trade Company disputes or charges back a payment after Credits have been issued or used, Tradeltop may remove the unpaid Credits, reverse Credits, create a negative Credit balance, suspend or restrict the account, and require payment before further Lead unlocks are allowed.
- where required by law;
- where Tradeltop materially breaches these Terms and cannot reasonably fix the issue;
- where Tradeltop agrees in writing; or
- under the Lead review and Credit return policy above.
12. AI Features, Estimates, And Suggestions
Tradeltop uses AI-assisted features to:
AI-assisted outputs may be incomplete, inaccurate, outdated, unsuitable, or based on incomplete user input.
Users must review AI-assisted outputs before relying on them or sending them to others.
AI-assisted outputs do not replace professional advice, trade assessment, site inspection, safety assessment, engineering advice, legal advice, financial advice, or a formal quote.
Trade Companies remain responsible for their quotes, descriptions, messages, representations, and work.
Customers remain responsible for checking whether the Job details and selected Trade Company are suitable.
- analyse a Customer's job description and generate follow-up questions to help create a clearer Lead;
- attempt to identify the trade category required for a Job;
- generate a final Job description or Job summary based on the Customer's original description and answers; and
- optionally generate a Trade Company bio from company-provided descriptions, notes, keywords, or similar business information.
13. User Content
Users may submit content through the Platform, including Job descriptions, answers, photos, addresses, company profiles, logos, images, documents, quotes, messages, and support requests.
You retain ownership of content you submit, but you grant Tradeltop a worldwide, royalty-free licence to host, store, copy, display, process, adapt, transmit, and use that content as reasonably necessary to operate, improve, support, and protect the Platform.
If you submit content for public display, such as Trade Company profile content, logos, showcase images, service descriptions, or public reviews if supported by the Platform, you also grant Tradeltop a worldwide, royalty-free licence to display and use that public content in connection with operating, promoting, and marketing the Platform.
You warrant that:
Tradeltop may remove, hide, restrict, or moderate content if we reasonably believe it breaches these Terms, creates legal risk, affects safety or trust, or may damage the Platform.
If Tradeltop displays ratings, reviews, recommendations, badges, or similar trust signals, Tradeltop may publish additional review, moderation, or trust rules explaining how those signals are collected, checked, moderated, displayed, and removed.
- you have the rights needed to submit the content;
- the content is accurate and not misleading;
- the content does not infringe another person's intellectual property, privacy, confidentiality, or other rights;
- the content does not include unlawful, abusive, discriminatory, pornographic, threatening, defamatory, unsafe, or malicious material; and
- the content does not include another person's personal information unless you have authority to provide it.
14. Messaging And Communications
Users may receive Platform messages, emails, SMS, push notifications, service alerts, security alerts, job updates, quote updates, payment notices, and support communications.
Trade Companies must not use Customer contact details for unrelated marketing or ongoing promotion unless the Customer has separately consented and the communication complies with spam and privacy laws.
Commercial electronic messages from Tradeltop, such as promotional offers or marketing campaigns, will only be sent where Tradeltop has consent or is otherwise permitted by law. They will identify Tradeltop as the sender, include contact details, and include an unsubscribe method where required by law.
Where an unsubscribe method is required by law, Tradeltop will take reasonable steps to make the unsubscribe method clear, functional, and actioned within 5 working days or any other legally required timeframe.
Users must not use Platform messaging to harass, threaten, spam, mislead, abuse, discriminate, solicit unlawful work, bypass Platform rules, scrape data, or send malware.
15. Privacy
Tradeltop handles personal information in accordance with its Privacy Policy.
The Privacy Policy explains what personal information Tradeltop collects, why it is collected, how it is used, who it is disclosed to, how long it is kept, how users can access or correct it, and how users can make privacy complaints.
Tradeltop may need to disclose Customer Job details and contact information to Trade Companies where required for matching, quoting, messaging, support, lead unlocks, or Job management.
Tradeltop collects Customer address information to help locate the Job accurately and match nearby Trade Companies. Unless the Customer chooses to share more, Trade Companies only see the state, city, suburb, and postcode for the Job, including after purchasing Customer contact details.
Tradeltop processes uploaded images before upload by converting and resizing them to JPEG where supported. This is intended to reduce uploaded file size and avoid sharing original file metadata.
Tradeltop may need to disclose Trade Company profile, contact, credential, location, service area, availability, quote, and message information to Customers and other relevant users.
If AI, analytics, maps, payments, messaging, storage, hosting, support, identity, or other third-party processors are used, the Privacy Policy should explain the relevant categories of disclosure.
16. Acceptable Use
Users must not:
- break the law or encourage others to break the law;
- provide false, misleading, fraudulent, or incomplete information;
- impersonate another person or business;
- misuse another person's personal information;
- scrape, crawl, harvest, copy, reverse engineer, or misuse Platform data;
- interfere with the security, stability, availability, or performance of the Platform;
- upload malware or harmful code;
- bypass payment, Credit, matching, verification, review, or access controls;
- create multiple accounts to avoid restrictions or obtain improper benefits;
- use the Platform to send spam or unsolicited marketing;
- discriminate unlawfully;
- post or seek unsafe, illegal, or regulated work that cannot lawfully be arranged through the Platform; or
- use the Platform in a way that may harm Tradeltop, users, or the public.
17. Suspension, Removal, And Termination
Tradeltop may suspend, restrict, remove, or terminate access to the Platform if we reasonably believe:
Where reasonable, Tradeltop will aim to give notice and an opportunity to respond. Immediate suspension may be used where Tradeltop reasonably considers it necessary for serious, urgent, unsafe, unlawful, payment, fraud, privacy, or security-related concerns.
Users may close their account by contacting support or using any account closure tool made available in the Platform.
Account closure does not remove accrued payment obligations or non-excludable legal rights. After account deletion, we retain the limited records described in section 14 of the Privacy Policy for the purposes stated there, subject to applicable legal retention obligations. Terms intended to survive termination continue to apply.
If Tradeltop suspends, restricts, removes, or terminates an account and later determines that the action was not reasonably necessary, Tradeltop will take reasonable steps to correct the issue. Depending on the circumstances, this may include reinstating access, restoring Credits incorrectly removed, returning Credits incorrectly consumed, or providing another fair resolution.
If Tradeltop permanently terminates or materially restricts a Trade Company account for reasons other than breach of these Terms, fraud, chargeback, payment failure, unlawful conduct, safety risk, privacy or security risk, or legal requirement, Tradeltop will take reasonable steps to provide a fair resolution for unused Credits that can no longer reasonably be used.
- you breached these Terms;
- your account information is inaccurate, misleading, incomplete, or outdated;
- your use creates legal, safety, privacy, security, payment, operational, reputational, or trust risk;
- payment fails or a chargeback occurs;
- you misuse Credits, Leads, Customer data, messaging, or support processes;
- a licence, insurance, ABN, credential, or authority appears invalid or misleading;
- we are required to do so by law; or
- continuing access would be unfair or unsafe for other users.
18. Platform Availability And Changes
Tradeltop may update, improve, suspend, remove, or change Platform features from time to time.
Where a Platform change is likely to materially disadvantage an existing paid feature or Credit balance, Tradeltop will take reasonable steps to give affected Trade Companies notice before the change takes effect unless the change is urgent, required by law, needed for safety, security, fraud prevention, or does not materially disadvantage affected users.
Tradeltop does not guarantee that the Platform will be uninterrupted, error-free, compatible with every device, available in every location, or available for every trade category.
Tradeltop may run experiments, beta features, limited launch areas, invite-only features, or waitlists.
Platform changes will not apply retrospectively to a completed Credit purchase or completed paid feature in a way that materially disadvantages the Trade Company, unless required by law, needed for safety, security, or fraud prevention, or unless Tradeltop provides a fair resolution for any materially affected unused Credits. A Trade Company may nevertheless voluntarily elect to forfeit unused Credits by confirming account deletion after seeing its current balance and having the opportunity to cancel and use those Credits. That election remains subject to non-excludable legal rights.
If a material Platform change removes or substantially reduces the main paid feature for which unused Credits were purchased, affected Trade Companies may stop using paid features and ask Tradeltop to review a fair outcome for their unused Credits.
19. Intellectual Property
Tradeltop owns or licenses the Platform, including software, design, branding, workflows, templates, matching logic, AI prompts, content, trade marks, logos, and other intellectual property.
Users must not copy, reproduce, modify, distribute, sell, reverse engineer, or create derivative works from the Platform except as allowed by law or with Tradeltop's written permission.
Users may use Platform materials only as reasonably necessary to use the Platform in accordance with these Terms.
20. Third-Party Services
The Platform may integrate with third-party services, including payment processors, maps, identity services, analytics tools, hosting providers, AI providers, communication services, app stores, and external websites.
Third-party services may have their own terms, privacy policies, fees, limitations, and availability rules.
Tradeltop is not responsible for third-party services except to the extent required by law.
21. Australian Consumer Law And Non-Excludable Rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, condition, right, remedy, liability, or other protection that cannot lawfully be excluded, restricted, or modified.
Where the Australian Consumer Law applies to Tradeltop's supply of Platform services, Tradeltop's Platform services must be provided with due care and skill, be reasonably fit for any purpose made known to Tradeltop where that guarantee applies, and be supplied within a reasonable time where no time is set.
To the extent permitted by law, Tradeltop's liability for failure to comply with a non-excludable guarantee in relation to services may be limited to resupplying the services or paying the cost of having the services resupplied.
22. Liability
To the extent permitted by law, and subject to section 21, Tradeltop is not liable for loss to the extent the loss is caused by or arises from:
To the extent permitted by law, and subject to section 21, Tradeltop's aggregate liability arising out of or in connection with these Terms is limited to the amount paid by the relevant user to Tradeltop for the Platform feature giving rise to the claim in the 12 months before the claim arose.
This section does not limit liability that cannot legally be limited, or liability caused by Tradeltop's fraud, wilful misconduct, gross negligence, or intentional misuse of personal information.
- trade work performed by Trade Companies;
- payment for trade work, including deposits, invoices, refunds, chargebacks, timing, payment method, or non-payment;
- a Customer's decision to engage or not engage a Trade Company;
- a Trade Company's decision to unlock, quote, accept, decline, or perform a Job;
- Job details, photos, messages, quotes, or content provided by users;
- loss caused by inaccurate, incomplete, or outdated user information;
- loss of profits, revenue, opportunity, goodwill, data, or anticipated savings;
- indirect, consequential, special, or punitive loss;
- Platform downtime, technical issues, third-party service failures, or payment processor failures; or
- events outside Tradeltop's reasonable control.
23. Indemnity
To the extent permitted by law, you indemnify Tradeltop and its officers, employees, contractors, and agents against reasonable losses, claims, costs, expenses, damages, and liabilities to the extent caused by:
This indemnity does not apply to the extent the loss is caused or increased by Tradeltop's fraud, wilful misconduct, negligence, breach of these Terms, or failure to take reasonable steps to mitigate the loss.
- your breach of these Terms;
- your unlawful, misleading, unsafe, or negligent conduct;
- your content;
- your misuse of another person's personal information;
- your trade work, quotes, invoices, warranties, representations, or services;
- your breach of a Customer or Trade Company agreement;
- your breach of licence, insurance, safety, privacy, spam, consumer, building, or trade laws; or
- another person's use of your account where you failed to keep access secure.
24. Disputes And Support
Users should first contact Tradeltop support at support@tradeltop.com if they have a Platform issue.
Customers and Trade Companies should try to resolve trade work, quote, payment, delay, damage, warranty, or workmanship issues directly with each other.
Tradeltop may choose to provide support, request information, restrict accounts, reverse Credits, remove content, or help users communicate, but Tradeltop is not required to resolve disputes between users.
These Terms do not prevent a user from contacting a regulator, fair trading authority, tribunal, court, police, insurer, lawyer, or other appropriate body.
25. Changes To These Terms
Tradeltop may update these Terms from time to time.
If changes are material, Tradeltop will take reasonable steps to notify affected users before or when the changes take effect.
Where a material change is likely to adversely affect an existing paid feature or Credit balance, Tradeltop will aim to give at least 30 days' notice unless the change is urgent, required by law, needed for safety, security, or fraud prevention, or does not materially disadvantage affected users.
Changes will not apply retrospectively to a completed Credit purchase or completed paid feature unless required by law or unless the change benefits users. A Trade Company may nevertheless voluntarily elect to forfeit unused Credits by confirming account deletion after seeing its current balance and having the opportunity to cancel and use those Credits. That election remains subject to non-excludable legal rights.
Continued use of the Platform after changes take effect means you accept the updated Terms.
26. Governing Law
These Terms are governed by the laws of Queensland, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them.
